Bombay High Court protects ‘MEFTAL‑SPAS’ trademark

The Bombay High Court has recently issued a permanent injunction against a Gorakhpur-based firm for manufacturing a medicine deceptively similar to Blue Cross' MEFTAL-SPAS painkiller. In its ruling, the Court found that the defendant's product, which bore a striking resemblance to the original, was likely to cause confusion among consumers and dilute the reputation of the genuine product. As a result, the Court granted a permanent injunction against the defendant and ordered them to pay ₹10 lakh in costs to Blue Cross.
